What’s new? (Dec 2022)

For approved Medical leave, Coda pays 100% for 2 weeks inclusive of any income from Guardian disability or the state. Any additional time, if approved, is paid by Guardian disability and/or the state where applicable. Previously, only a portion of your income (60% to $2,500 per week) was covered along with an unpaid 7-day waiting period at the start of one’s medical leave. Coda will top up for two weeks to ensure 100% pay.

Medical Leave Top Up Details

Time & Pay: 2 weeks of 100% pay
Who’s eligible?: US-based full time or part time (30 hours) Codans and must meet the definition of short term/long term disability or medical leave. There is no tenure requirement.

A medical leave of absence is a leave category for employees who face medical conditions that affect their physical and/or mental health to the point that they can no longer perform key job responsibilities.
Depending on your situation, there may be select programs you are eligible for, a couple being FMLA and ADA. If you’re ever unsure, please consult [contact] .

Family and Medical Leave Act (FMLA)

The Family and Medical Leave Act (FMLA) is a federal law designed to help workers balance job and family responsibilities by giving employees up to 12 weeks of unpaid leave per year for specific medical reasons. Eligible employees can take up to 12 weeks of leave for treatment of or recovery from serious health conditions, to care for an immediate family member who has a serious health condition, and a variety of situations including pregnancy, illnesses, injuries, impairments, or physical or mental conditions that require multiple treatments and intermittent absences. Generally, things like cosmetic surgery, colds, headaches, and routine medical and dental care are not included.

Family and Medical Leave Act (FMLA) Eligibility

Pursuant to the federal Family and Medical Leave Act (“FMLA”) and the California Family Rights Act (“CFRA”), eligible employees may take an unpaid Family and Medical Leave of absence as described below.
To be eligible for Family and Medical Leave, an employee must:
Have worked for Coda for at least twelve months prior to the date on which the leave is to start
Have worked at least 1,250 hours in the twelve (12) months preceding the start date of the leave.
Work at a location where Coda employs more than 50 persons within 75 miles (Coda is flexible on this eligibility requirement).
IMPORTANT: FMLA is a federal job protection leave. No monetary benefits will be provided unless FMLA is layered with a different leave type that includes monetary benefits.

Requesting FMLA Leave:

If your need for FMLA is foreseeable, you must submit your request at least 30 days before the start date of your leave. If your need for FMLA is not foreseeable, you must submit your request as soon as practicable. Please follow these steps to initiate your leave:
Coda partners with Cocoon, our medical leave administrator, to assist with FMLA. They will be your go-to resource for navigating you through your leave.

ADA Accommodation

The Americans with Disabilities Act is a federal law that provides civil rights protections to individuals with disabilities similar to those provided to individuals on the basis of race, color, sex, national origin, age and religion. A job accommodation is an adjustment to a job or work environment that makes it possible for an individual with a disability to perform their job duties. This is different from a medical leave which is protected under FMLA (and has different eligibility requirements).

The Americans with Disabilities Act defines a qualified individual with a disability as a person who meets legitimate skill, experience, education, or other requirements of an employment position that he or she holds or seeks, and who can perform the "essential functions" of the position with or without reasonable accommodation.
