Identify Legal Gateways

For , you will need to identify one or more Legal Gateway that permits data to be used for the Purpose.
This should be determined in consultation with your Legal Team and practitioners.
It may be helpful to refer to other organisations who have already reused data for this Purpose.
In some cases, where the law is silent on the issue of data sharing, a Controller may be able to rely on a implied power. An implied power for a public body, is a governmental authority not explicitly written in a statute or constitution but considered necessary and proper to effectively carry out its express duties. Therefore, an implied power to share information may be derived from the express provisions of legislation.

Legal Gateways should refer to sections in Acts and Regulations that explicitly allow personal data that was collected for an original Purpose, to be reused for another Purpose.

If no Legal Gateway can be found, the data processing cannot continue.

Consider unblocking legal access to the data using escalation options such as the Digital Economy Act.
