Healthcare advertising in Spain is regulated by the Spanish Agency of Medicines and Medical Devices (AEMPS) to ensure patient safety and ethical standards. Here are some key points:
- Over-the-Counter Medications - The only medical products allowed to be directly advertised to the general public in Spain. Includes mild analgesics, cough/cold remedies, digestive aids, mineral supplements, etc.
- Prescription Medicines - Cannot be marketed directly to patients. Pharmaceutical ads are limited to medical publications/events targeting healthcare professionals. Very strict rules around truthfulness, objectivity and backing claims with scientific evidence.
- Medical Devices - Can be advertised to healthcare providers outlining factual product specs and intended uses. Consumer advertising must avoid misleading descriptions or unsubstantiated claims.
- Healthcare Facilities - Hospitals, clinics and practices can advertise to inform the public of the services they provide. Cannot make unfair comparisons or superiority claims over competitors.
- Alternative Medicine - Heavily restricted around what types of claims can be made regarding health benefits, treatment outcomes, recommendations over standard medical advice, etc. Fines for non-compliance.
- Health Products - General wellness products are regulated by consumer protection agencies to avoid false or exaggerated claims of effects on health, body functions or slimming.
The AEMPS regularly issues guidance on healthcare advertising and penalizes offenders with sanctions, fines, and orders to halt misleading promotions.
