Germany also has strict regulations around healthcare advertising to protect consumers:
- Over-the-counter (OTC) medicines - Similar to France, OTC medications like painkillers, allergy meds, cough syrups, can be advertised directly to consumers.
- Medical devices & equipment - Germany is a major medical device manufacturer. Advertising rules require claims about technical performance, safety and intended purpose to be factual and evidence-based.
- Prescription medicines - Cannot be promoted directly to the general public. Pharma ads are limited to medical journals and professional events targeting healthcare practitioners.
- Hospitals & physicians - Healthcare providers can advertise to inform the public of their services, methods, areas of specialization and other factual details. Comparisons claiming superiority are restricted.
- Alternative therapies - Advertising rules also apply to alternative medicine offers like homeopathy, chiropractic, acupuncture, nutritional advice. Claims must not promise unrealistic outcomes.
- Health-related products - Supplements, vitamins and wellness products can be advertised following regulations by the Federal Institute for Drugs and Medical Devices (BfArM) around truthful claims.
Violations of healthcare advertising rules can lead to fines, injunctions forcing ads to stop, and corrective statements. Germany aims to ensure ethical, non-exploitative promotion of treatments.
