Even your side of the conversation is an attorney/client privileged and confidential communication, but you do not need our consent to record just your own statements, provided you are not recording anything that I say. We recommend nonetheless, that you do not record at all. Recording only part of a conversation carries the additional risk of having the statement construed out of context at a later time. I’m not able to give permission for you to record my statements. If you would like me to send you an email summarizing our conversations afterwards, I would be happy to do that. There are different risks associated with audio recordings versus written communications. For example, our email system has security features to protect confidentiality and emails also can be more readily authenticated.
