<p>This agreement sets out the terms and conditions on which the Checkers Xtra Savings.ai Festive Art (“the tool”) is provided free of charge to you until 25 December 2022. Your access to the Tool is completely at the discretion of Checkers. Access to the Tool may be blocked, suspended or terminated at any time for any reason including, but not limited to, violation of this Agreement, actions that may lead to liability of Checkers and its suppliers, disruption of access to other users and violation of applicable laws and regulations.</p>
<p>Checkers and its suppliers reserves the right to monitor and collection information from the Tool for the purposes of moderation and improvement of the Tool. Checkers may revise this agreement at any time. You must accept this Agreement each time you use the Tool and its your responsibility to review for any changes each time. We reserve the right at all time to withdraw the Tool. If you do not agree with these terms, including changes thereto, do not use the Tool.</p>
<h2>CAMPAIGN SUMMARY</h2>
<h2>Checkers XtraSavings.ai Festive Art</h2>
<p>The Festive AI art creator is a web application that allows anyone to describe any scene they want to see, add a specific art style, and get a newly created, totally novel, piece of festive art back. This app is powered by two new Artificial Intelligence computer programs developed by OpenAI. The first of these AI programs is GPT-3 - a “large language model” that’s been trained to understand and interact in written text, especially English. Then we have DALLE-2 - an “image generation” model that generates a unique images based on any written text request. The Festive art creator is using GPT-3 to take your scene description and turn it into something really festive and exciting, and then using DALLE-2 to bring that idea to life as an artistic image. This software is provided free-of-charge.</p>
<p>We ask that you do not try and create any image that may be deemed offensive, hurtful or upsetting to those around you. All generated images should be suitable for public consumption (ie. rated G) and should not include celebrities or politicians. For a full list of guidelines, see OpenAI’s content policy.</p>
<p>Checkers requires users to:</p>
<ul><li>Be over the age of 18 years</li></ul>
<ul><li>Adhere to the OpenAI’s content policy that disallows the use of inappropriate images or input that purposefully aims at generating images and content that do not adhere to the guidelines</li></ul>
<p>We and our Suppliers own all rights, title, and interest in and to the Tool and where applicable, the Tool will be subject to all terms and conditions as stated by our primary service provider OpenAI at https://openai.com/api/policies and
<p>We store details about your usage of the app including what you input and output and where you are accessing the service from. We may use your inputs and outputs to improve the service but will not share your information with any external parties. Please note, due to the nature of machine learning, Output may not be unique across users and the Tool may generate the same or similar output for another user. Images you generate through this app may be made publicly available.</p>
<h2>Restrictions</h2>
<p>Checkers reserves the right to restrict usage and access of users who:</p>
<ul><li>Use the Tool in a way that infringes, misappropriates or violates any person’s rights;</li></ul>
<ul><li>Attempt to reverse assemble, reverse compile, decompile, translate or otherwise attempt to
discover the source code or underlying components of models, algorithms, and systems of the
Tool</li></ul>
<ul><li>Use any method to extract data from the Tool, including web scraping, web harvesting, or web
data extraction methods;</li></ul>
<ul><li>Misrepresent that output from the Tool was human-generated when it is not.</li></ul>
<p>Checkers shall have the right to change or terminate the Tool immediately and without notice, if
deemed necessary in its opinion and if circumstances arise outside of their control.</p>
<p>Checkers, its agents, its associated companies, nor any directors, officers, or employees of such,
shall be liable for any loss or damage, whether direct, indirect, consequential, or otherwise arising
from any cause whatsoever, which may be suffered by a participant resulting from participation in this
campaign or use of the Tool.</p>
<p>The usage of the Tool constitutes acceptance of the aforementioned terms and conditions and users
agree to abide by the rules.</p>
<p>In the event of a dispute regarding any aspect of the campaign or Tool and/or these terms and
conditions, the decision of Checkers will be final and binding and no correspondence may be entered
into.</p>
<p>Checkers is not liable for any technical failures affecting participation in the campaign or use of the
Tool and assumes no liability whatsoever arising from negligent acts or omissions of Checkers and its
affiliates.</p>
