Defendant made a 998 offer in a contract dispute where contract had a prevailing party entitled to attorney fees provision. Plaintiff did not beat the 998 offer. A defendant whose 998 offer exceeds what a plaintiff obtains at trial is the prevailing party, and if attorney fees are available, that defendant can move the court for [post-offer] attorney fees.
