The Cafe Melo Club (herein "the Club") is a membership-based establishment available to all individuals over the age of 21 in the State of New York. The Club aims to provide a community and various services to its members to enhance their daily lives.
III. Membership Agreement
By signing this agreement, you become a member of the Cafe Melo Club and agree to adhere to the Bylaws of Cafe Melo, as provided to you by the Club and posted on the Club premises. After completing your 30-day trial, if you opt to renew your membership, you will be required to pay either a monthly fee of $50, depending on the payment plan you choose. Upon payment of the chosen membership fee, Cafe Melo grants you a license to access the Club's premises where you can enjoy all the benefits of Membership during the selected membership period, whether on a monthly basis or as per the terms of your chosen plan. You also consent to receiving communication from Cafe Melo through text and/or email regarding your membership and promotions.
You affirm under penalty of perjury that the information provided above, including your true name, occupation or business, email, and cellular/home number, is accurate. By signing this Membership Agreement, you further certify under penalty of perjury that you have no affiliation with any competing club or business, nor are you connected to any governmental agency or department seeking to regulate or prosecute any industry Cafe Melo is involved with. Failure to disclose such affiliations shall be punishable under applicable law and may result in liquidated damages of $50,000.00 (Fifty Thousand Dollars) and related attorney's fees in any action seeking enforcement of Cafe Melo's rights under this contract.
IV. Conduct and Code of Ethics
General Conduct Expectations
Members are expected to conduct themselves in a respectful and courteous manner towards fellow members and staff.
Any form of harassment, discrimination, or disruptive behavior is strictly prohibited.
Respectful and Inclusive Behavior
Members must respect the diversity and inclusivity of the Cafe Melo community.
Discriminatory language or behavior will not be tolerated.
V. Termination and Suspension of Membership
Grounds for Termination or Suspension
Cafe Melo reserves the right to terminate or suspend membership for violations of conduct, non-payment of fees, or breach of the Membership Agreement.
Due Process for Termination or Suspension
Members subject to termination or suspension will be provided with an opportunity to present their case before any final decision is made.
Appeal Process for Disputed Terminations
Members have the right to appeal any decision of termination or suspension.
Consequences of Termination or Suspension
Termination or suspension will result in loss of membership privileges and benefits, as outlined in the Bylaws.
MEMBERSHIP WAIVER LIABILITY
Acknowledgment of Risk, Release, and Waiver of Liability:
As a member of Cafe Melo Club, I acknowledge the inherent risks associated with utilizing the Club's services and hereby release the Club from any liability stemming from the services provided.
By signing this agreement, I commit to engaging with Cafe Melo Club exclusively for the purpose of accessing the services and benefits offered by the Club.
