The following are points that need to be listed in our MN Practitioner Agreement
Do we have to have separate agreement for companies whose employees take the course? Do their employees also have to sign too? At what point is this signed? When do we show it to them? Do we show this first? Or a non-contract version with the points? Agreement for INDIVIDUAL PRACTITIONER WITH MNI
Agreement between MNI and Party pertaining to the certification of Party as a Certified MN Practitioner MNI - Multiple Natures International, LLC The Program or The MN Practitioner Training Program - a certification course run by MNI that trains individuals to become Certified MN Practitioners and conduct MN Consultations. Candidate - the individual undertaking the MN Practitioner Program MN Instructor - a certified educator assigned by MNI to lead the MN Practitioner Training Practitioner (or MN Practitioner) - a person who has completed all requirements of the MN Practitioner Training Program. Client - an individual whom the Practitioner serves in an MN Consultation MNTEST - an online diagnostic tool created by MNI that consists of a 76-question assessment and a second assessment run by an algorithm that determines the strength of an individual's 10 Multiple Intelligences and 9 Multiple Natures on a 10 point scale. MN Report - a multi-page report generated by a Practitioner after the Client has Multiple Intelligences (MIs) - a psychological framework of Howard Gardner identifying 10 human abilities, namely, Bodily (Gross), Bodily (Fine), Interpersonal, Logical, Linguistic, Visual (Graphic), Visual (Spatial), Musical, Intrapersonal, and Naturalistic. Multiple Natures (MNs) - a psychological framework of Steven Rudolph identifying 9 human tendencies, namely, Protective, Educative, Administrative, Creative, Healing, Entertaining, Providing, Entrepreneurial, and Adventurous. Multiple Natures may also refer to the overall MN System (see below) depending on the context. MN Consultation - a process conducted by an MN Practitioner with a client, where the client takes the MNTEST, and the Practitioner provides guided facilitation to help the client validate their scores, create matching reports of careers, tasks, and hobbies, and provide insights on how the client can best engage their various abilities (MIs) and tendencies (MNs) in their personal and professional lives. MN Method - a methodology used by an MN Practitioner while working with a Client that makes use of the MN Test, the MN Validation Process, MN Reports during the course of an MN Consultation. MN System - the entire range of components created by Multiple Natures International related to the Multiple Natures concept and MN Methodology. MN Dashboard - the online software interface used by a Practitioner to issue MN Test invitations, perform MN Validations, and generate MN Reports. MN Validation - a process undertaken by a Practitioner to cross check a Client's MI and MN scores from the MN Test and adjust them through facilitative techniques in a manner that is in keeping with the Client's views, feelings, and beliefs. MN Profile - a Client's MI-MN Scores and their MN Report results that is stored online in the Practitioner's MN Dashboard and available to the Client through their MN Account. MN Account - a personal, online account created for a Client that consists of their MN Test results and MN Report created by their respective MN Practitioner. MN Academy - the learning management system (LMS) used by MNI for sharing course materials MN Content - refers to all original, content, materials, books, articles, courses, videos, audio files, documents, presentations, etc., that are owned, published, shared, distributed, etc. and copyright MNI. Brand Book - a document with guidelines of how Practitioner must use the MN Logo and other elements related to the MN Brand. Certification - refers to the formal recognition of an individual after completing all requirements of the Program. Territory - the area defined by MNI within which the Candidate conducts their MN Consultations. Licensee - an individual or organization appointed by MNI to carry out marketing andof the MN System
A. Candidate agrees to maintain the ethics and standards of behavior established by MNI (Appendix X). By signing this agreement, Candidate acknowledges that they have fully and carefully read the MNI Code of Ethics and the applicable standards of behavior described therein, and that they will abide by them, and that failure to do so may result in the immediate termination of the Party's certification.
B. Candidate acknowledges that MN Consultations do not involve the diagnosis or treatment of mental disorders (as defined by the American Psychiatric Association). Further, they may not to be used as a substitute for psychological counseling, psychotherapy, psychoanalysis, mental health care, substance abuse treatment, or other professional advice by legal, medical or other qualified professionals.
Providing training from qualified instructors To provide all course materials for the Program Provide name in profile after Candidate completes all requirements Technical support (troubleshooting, problem solving) within a reasonable period of time. Responsibility of Candidate To provide usage? support of tools (how to use, how to read/understand/interpret) to its clients Party can not outsource its MN services to any third party Party cannot have assistants do any MN work for them (access database, send links, generate reports, etc.), without written permissionーand those people also have to sign agreement of confidentiality and privacy. What about announcing pricing of MNTEST to clients? What about following a suggested retail range? (Rytis, you said this is illegal i Europe) LIMITATIONS /TERRITORY ???? Party may conduct their MN Consultations....withing territory?????? MNI makes no guarantee that Party will be able to earn from this program. Party assures MNI that they are in good physical, mental, financial health that permits them to carry out their responsibilities / and doesn't compromise their performance Don't misrepresent themselves with respect to their certifications, qualifications, titles, etc. Does not violate intellectual property usage of Multiple Natures or any third party, including but not limited to the use of content, images, video, music, etc., that are copyright protected. Should be clear that the presentations we share are representative; that MNI uses multimedia and has obtained all proper licenses for use of that content. If Party wants to make use of it, it is its own responsibility to do so. Does not alter content, concepts, definitions, of MN-Related Content On payments for courses (if not paid in full)? Intellectual Property and Confidentiality Recognizes industry secrets; will not reveal or share Recognizes MNI Trademarks Will not share with any third party the following: Course Content, Passwords to the MN Academy or their MN Account. Will not share Client Reports with any third party without the express, written consent of the Client. Strictly adhere to MNI Brand Book Guidelines May not publish digital or print material until it is approved by MNI if found in violation, MNI will provide feedback within 7 business days. Only after written approval may Party publish MNI not responsible for costs to Party due to violation of brand guidelines Will not create any social media pages using the name Multiple Nature Privacy, Confidentiality, and Record Retention Party must agree to follow MNI privacy policies (if in Europe or servicing European customers then GDPR) Will not make or use alternative assessments Will not aim to by-pass the MNTEST and do manually Will not create any courses, content, books, etc., that incorporate Multiple Natures-related content. Revocation of Certification MNI reserves the right to revoke if Party violates code of ethics. If MNI determines that Party is not fit (balanced), MNI can revoke Certification Party would be responsible to return monies to existing clients if requested (MNI is indemnified) Party agrees to immediately stop use of titles, and remove/change website, business cards, etc., within a period of (2 months)? If not, penalty of EUR 100 per day that it is not removed/changed. Evaluation and Certification After completing 10 consultations, Party must undergo a 90 minute evaluation by MNI or one of its authorized representatives. Must achieve 80% on the evaluation to pass. If Party fails to achieve the minimum marks, they will have the option to be re-evaluated within 3 months of the evaluation. Party must pay $350 for a re-evaluation. If the Party fails to achieve minimum marks, they will be ineligible to earn their certification. If the Party still wishes to become a certified MN Practitioner, they will need to re-register for the course and again complete all course requirements. MNI reserves the sole right to determine if Party is deserving of Certification. Change in Policies, Content, and Training Dates/Times MNI reserves the right to make changes to its policies, content, and MN-related concepts at any time. MNI will honor requisites of any course and/or certification once an individual has registered and made full payment. Party will have 6 months to comply with changes MNI reserves the right to change course dates due to instructor illness or unavailability or other schedule conflicts. MNI will make all efforts to accommodate the Party's schedule....???? Continuing Education Credits In order to keep certification, Party agrees to staying updated. Party must perform at least 10 consultations per year. Every 3 years, Party must complete at least 12 hours of instruction in new MN Courses from MNI or its authorized partners. MNI reserves the right to appoint licensees in territories throughout the world. In the case a licensee is appointed in Party's territory, licensee must comply with policies conferred to the Licensee. Limited Liability (Indemnification?) If it breaches terms, privacy, copyright, third party claims Appendices
Appendix 1: What MNI Delivers MN Dashboard (for sending emails and making reports) Additional one-on-one time may be scheduled with the Instructor or other Instructors approved of by MNI at an additional cost of ________ per hour, in increments of 30 minutes. Appendix 2: Program Costs Cost of the MN Practitioner Training Program is EUR 1850. MN Test and Consultation is EUR 250. MN Test Credits are EUR 1 per credit. Cost of a single MN Test is (PUT DETAILS HERE ABOUT NEW PAYMENT SCHEDULE) Make full payment for course Perform evaluation of 90 minutes after 10 consultations Perform final evaluation of 30 minutes after 20 consultations Appendix 3: Practitioner Requirements Perform mid-term evaluation Perform 10 additional consultations Perform final consultation Provide all details to MNI for online profile
