This is a legally binding agreement. It is intended to help promote harmony by clarifying the rights, duties, and responsibilities of property owners, managers, and renters.
This is a short term rental agreement that has been agreed upon by both the Property Owner, ________________, located at the residence of “ “, and the Guest Renter _________________. The Property Owner has agreed to rent to the Guest for one month from the dates of _______________ to _______________.
The Property Owner has agreed to allowing the Guest to occupy the “ “ located on the property of ___________________ under the following conditions;
1. The Guest will tend to the beautification of the building and surrounding property. This includes deep cleaning of interior and grounds of property, interior designing, labor, and gardening. Guest agrees to create a beautification list/ database with all proposed tasks, which must be reviewed and confirmed by the Property Owner before completed.
2. The Guest is to pay a cash amount agreed upon with the Property Owner to support the utility bills for the month that the tenant will be occupying the building.
3. The Guest will relocate into another part of the building or into another living structure if the building is rented out for any purpose, from which the amenities that the Guest is occupying will be needed. Arrangements will be addressed and made accordingly, per each situation. The Guest requests a notice of 24 hours prior to the relocation, and with new accommodations made readily available.
4. The Guest can store belongings on property for the period of the rental agreement, and must vacate with belongings once the contract is over, leaving no personal property behind.
5. By the end of the 1 month term, the Guest will provide the Property Owner a rough draft outline of Investment / Collaborative Partnership Opportunities that have the potential to support the future development goals of the Ranch.
6. Both the Property Owner and the Guest have agreed to explore aligned opportunities over this coming month as they naturally arise in dialogue in regards to preparing for grounding clear initiatives around next steps to achieve the land development goals of the Property Owner. It is clear that only exploratory dialogue will take place. No actionionable tasks or responsibilities will take place until after this initial contract is complete. In order for any project initiative to take place between the two parties there will need to be a clear contract around the project initiative in place - stating clearly the tasks, guidelines, accountabilities, and value exchange agreed upon.
ADDITIONAL TERMS & CONDITIONS
The Property Owner has agreed upon and accepted the following as an exchange for occupying the Museum building located at New Frontier Ranch (16799 OR-66 Ashland Oregon, 97520).
Beautification of the building and grounds of the property Investment proposal for the future development of the New Frontier Ranch
GIFTING
Any additional hours worked on the Ranch outside of what has been agreed upon will be documented in a ledger and offered as a gift to the land. This may include labor on the land or business developments meetings and is not to exceed 12 hours over the length of the duration of the contract. If something is to be Gifted by the Property Owner is to be clearly stated to the Guest. All gifts of time and anything lese of value will be documented in a shared Ledger (google spreadsheet).
USE OF PROPERTY
Guest acknowledges and agrees that this agreement is only for transient occupancy of the property, and Guest does not intend to, nor is permitted to, make the property a residence or permanent household.
MAINTENANCE OF THE RENTAL PROPERTY
A.) OWNER’S/ AGENT’S DUTIES The Owner will provide the Guest with the following amenities, and will assure the Guest has access to these amenities at all times for duration of stay, even if the building changes in terms of relocating the Guest.
1. A water supply capable of producing hot and cold running water
2. Adequate heating/ cooling facilities
3. Electrical lighting
4. Internet/ Wifi
B.) GUEST DUTIES Guest agrees to: Keep the premises as clean and sanitary as the condition of the premises permits. Leave the building in the same or better condition as when possession was given.
D) EVACUATION In the case of a fire, a storm or severe weather and a mandatory evacuation order is issued by state or local authorities, the Guest will need to evacuate the property. Owner will not be liable or deemed in default under this Agreement for any failure to perform or delay in performing any of its obligations due to or arising out of any act not within its control.
DESTRUCTION OF THE RENTAL If, beyond the control of either party, the rental becomes partially or totally destroyed during the term of this Agreement, either party may thereupon terminate this agreement upon reasonable notice. Property Owner To State Insurance Coverage of Land. It is recommended that the Guest Renter carry a standard renter’s insurance policy to cover renter's personal property.
E.) DISPUTES AND REMEDIES If a dispute occurs relating to the rental of this property, either the Owner/Agent or the Renter may seek mediation before filing Small Claims or other civil action. Governing Law. This Agreement and all transactions contemplated by this Agreement will be governed by, and constructed and enforced in accordance with the laws of the State of Oregon (not including its conflicts of laws provisions). If the dispute cannot be resolved through mediation, then the dispute will be resolved through binding arbitration conducted in accordance with the rules of the American Arbitration Association.
F.) NOTICES Notices and requests will be made IN WRITING and given by email and verbally communicated between the Property Owner and Guest that a notice has been sent. Whomever is receiving the notice must reply within 24 hours of the email, stating they have received the Notice.
TENANCY NOTICES The Guest Renter will be given written notice of rent changes or changes in the terms of the tenancy by the Property Owner. The Guest Renter is to provide a written notice of any proposed rental changes or changes in the terms of the tenancy.
VACATE NOTICES Both Renter and Owner/Agent will give thirty (7) days written notice in the event that the rental is to be vacated. OTHER CHANGES The Owner/Agent will give written notice within ten (10) days of any change in managers, agents for receipt of rent, and owner (or agents authorized to act for the owner). Such notices will include the names, addresses, and phone number of such persons.
G.) INSURANCE (LIABILITY/ RENTERS) The Guest is responsible for personal belongings and is recommended that Guest Renter carry a standard renter’s insurance policy to cover renter's personal property. If the Guest is to engage in working on the property it is asked that the Guest carry and present a copy of Liability Insurance to cover any liabilities that may occur while working on the property. Both proof of documentation if applicable are to be presented at the time of signing this legal binding agreement.
H.) OCCUPANCY AND SUBLETTING A) The rental is for the residential use of the signer of this Agreement and is limited to (1) occupant, and cannot be occupied by another unless further rented by someone with the Property Owner. In this case the Property Owner must give as much notice to the Guest as possible regarding these agreements to occupy the space.
This Agreement represents the entire understanding and agreement between the Parties with respect to the subject matter of this Agreement and supersedes all other negotiations, understandings and representations (if any) made by and between the Parties.
The signing of this agreement acknowledges the Property Owner's and Guest Renter agree to the terms stated in this agreement.
